Deck the Docks to benefit Dogwood Animal Shelter
A new event this year at the lake! Dock Realty is hosting the lake’s first annual dock lighting contest called “Deck the Docks” to benefit the Dogwood Animal Shelter. Dogwood Animal Shelter is a non-profit, “NO-KILL” refuge for the homeless domesticated animals in the Lake of the Ozarks area. Their facility houses 200 of our furry friends that are waiting for that loving family to adopt them.
So gather your family, friends and co-workers to join us on one of the five Friday night cruises on the Celebration Cruise ship based on the west side of the Grand Glaize bridge. The cruises begin on November 25th and run every Friday evening until December 23rd. The cruise is 2 hours long and we will be viewing the lighted docks between the 13 and 21 miles markers. FERC Ruling on Lake of the Ozarks
The Federal Energy Regulatory Commission (FERC) today provided certainty for citizens at Lake of the Ozarks in Missouri by setting the record straight that FERC has not required shoreline homes and structures with valid deeds, permits and easements to be removed. The Lake of the Ozarks reservoir is part of the Osage Hydroelectric Project, licensed to Ameren UE.
“I am confident that today’s decision will bring clarity to residents along the shoreline of the Lake of the Ozarks,” FERC Chairman Jon Wellinghoff said. “I expect Ameren to move quickly to comply with the Commission order. This will resolve all outstanding issues associated with its shoreline management plan and bring this matter to a swift and satisfactory resolution.”
FERC’s prior order on this case, issued July 26, 2011, was misinterpreted to mean that the Commission would order all privately owned structures built within the boundaries of the Osage project to be removed. Ameren is responsible for managing the shoreline, which includes ensuring that structures within the project boundary around the Lake of the Ozarks are built with the proper authorizations.
Today’s order states:• Whatever property rights that owners have in lands within the boundaries of the Osage Project, whether conferred by deed, lease, easement or other conveyance, have not been and will not be altered by FERC’s actions today. Nothing in this order affects any previously issued valid permit authorizing a non-project use of project lands or waters.
• For structures without valid deeds, permits or easements, Ameren must determine whether they interfere with the Osage project. If they do, Ameren must take some action, such as redrawing the boundaries of the project, so those structures no longer are sitting on project lands. This would put them outside of the project boundaries and therefore outside of FERC jurisdiction.
• If any structure does interfere with the operation of the Osage project, Ameren and the structure owner must find a solution that satisfies both sides. Ameren itself has stated that after the project boundary is revised, it expects the majority of structures will no longer be considered nonconforming.
FERC established these requirements in the context of directing Ameren to change its shoreline management plan for the Osage project. Ameren must file with the Commission its plan to modify the project boundary by June 1, 2012.

Purpose: To educate all residents and all property owners who have concerns about Federal Energy Regulatory Commission (FERC) claiming lake front property with a recent ruling called the Shoreline Management Plan (SMP) standards. To unify our voices; understand our rights; inform our representatives at local and state levels as to how we want to see this issue resolved based on our constitutional rights as property owners at Lake of the Ozarks.

Speakers and Guests: County Surveyor, local realtors, home owners effected by the disputed property boundaries, County Commissioners and State Representatives
Residents and property owners want Ameren UE and FERC to abide by the original deeded easement created back in 1932 and is referenced in Schedule B under “EXCEPTIONS” in most Titles; located in Book 63, page 162 of the Camden County Warranty Deed Records as a part of the creation of the project boundary, Union Electric Land and Development Company, reserved an easement to all of the lands that became The Lake of the Ozarks. This conveyance was made, under authority of the Federal Power Commission. The easement granted to every lake owner of record, through chain of title for the past 79 years, reads:
“to use the surface of said lands, whether submerged or not, for any and all purposes whatsoever, including the erection and maintenance of improvements thereon,”
We are deeply concerned about the potential personal property take over by FERC and AmerenUE. The over extension of powers the FERC is demonstrating on behalf of Ameren, is in violation of our Constitution, Amendment V, "...nor shall be…deprived of..property, without due process of law; nor shall private property be taken for public use, without just compensation." The Primary purpose of Government is to Protect Property. Historically, protection of property rights was a critical issue leading to the Revolutionary War.
John Adams said, "Property must be secured or liberty cannot exist." The redistribution of Wealth is unconstitutional. The expropriating of property to transfer to others is unlawful and completely outside FERC’s powers. Property Rights are the Foundation that our Nation was built on.
We must not lose sight that personal property rights are being infringed upon by the Federal Government. Our Founders felt that Property Rights were in direct relation to our freedoms and liberties.
