Subject: FERC order to modifying and approving shoreline management plan.

Purpose: To educate all residents and all property owners who have concerns about Federal Energy Regulatory Commission (FERC) claiming lake front property with a recent ruling called the Shoreline Management Plan (SMP) standards. To unify our voices; understand our rights; inform our representatives at local and state levels as to how we want to see this issue resolved based on our constitutional rights as property owners at Lake of the Ozarks.

Speakers and Guests: County Surveyor, local realtors, home owners effected by the disputed property boundaries, County Commissioners and State Representatives
Residents and property owners want Ameren UE and FERC to abide by the original deeded easement created back in 1932 and is referenced in Schedule B under “EXCEPTIONS” in most Titles; located in Book 63, page 162 of the Camden County Warranty Deed Records as a part of the creation of the project boundary, Union Electric Land and Development Company, reserved an easement to all of the lands that became The Lake of the Ozarks. This conveyance was made, under authority of the Federal Power Commission. The easement granted to every lake owner of record, through chain of title for the past 79 years, reads:
“to use the surface of said lands, whether submerged or not, for any and all purposes whatsoever, including the erection and maintenance of improvements thereon,”
We are deeply concerned about the potential personal property take over by FERC and AmerenUE. The over extension of powers the FERC is demonstrating on behalf of Ameren, is in violation of our Constitution, Amendment V, "...nor shall be…deprived of..property, without due process of law; nor shall private property be taken for public use, without just compensation." The Primary purpose of Government is to Protect Property. Historically, protection of property rights was a critical issue leading to the Revolutionary War.
John Adams said, "Property must be secured or liberty cannot exist." The redistribution of Wealth is unconstitutional. The expropriating of property to transfer to others is unlawful and completely outside FERC’s powers. Property Rights are the Foundation that our Nation was built on.
We must not lose sight that personal property rights are being infringed upon by the Federal Government. Our Founders felt that Property Rights were in direct relation to our freedoms and liberties.
